ECC Fitness Center Waiver

ESSEX COUNTY COLLEGE
FITNESS CENTER WAIVER OF LIABILITY AND HOLD HARMLESS AGREEMENT

I, the undersigned, in consideration of being allowed to participate in activities at the Essex County College Fitness Center (the “Facility”), agree to the following terms:

Release of Liability: I hereby release, waive, discharge, and covenant not to sue Essex County College, the Board of Trustees, and their officers, agents, and employees (collectively, the “Releasees”) from any and all liability, claims, demands, actions, or causes of action arising from any loss, damage, injury, or death, whether caused by negligence or otherwise, that may occur while using the Facility or during transportation to or from the Facility.
Assumption of Risk: I acknowledge that participation in Fitness Center activities involves inherent risks, including injury or property damage. I voluntarily assume full responsibility for any such risks, whether caused by the negligence of the Releasees or otherwise.
Indemnification: I agree to indemnify and hold harmless the Releasees from any loss, liability, damage, or costs, including court costs and attorney fees, arising from my participation in activities at the Facility, whether caused by negligence or otherwise.
Binding Effect: This waiver is binding on my heirs, assigns, and personal representatives. It shall also bind my family and spouse (if any).
Medical Costs: I understand that the College is not responsible for any medical costs associated with injuries I may sustain while participating in activities at the Facility. I am encouraged to maintain adequate health and accident insurance coverage.
Compliance with Rules: I agree to become familiar with, and follow, all rules, regulations, and instructions regarding the use of the Facility. I understand that failure to follow these rules may result in my being asked to leave or suspended from the Facility.
Acknowledgment of Policies: I acknowledge that my participation in the Facility requires adherence to all College policies, and I accept full responsibility for any activity conducted in violation of such rules or directives.
Governing Law: This Agreement shall be governed by and construed in accordance with the laws of the State of New Jersey.

I have read, fully understand, and voluntarily agree to the terms of this Waiver of Liability and Hold Harmless Agreement. I fully understand it and sign it voluntarily as my own free act and deed; no oral representations, statements, or inducements, apart from this written agreement, have been made. I am at least eighteen (18) years of age and fully competent, and I execute this release for full, adequate, and complete consideration, fully intending to be bound by it.
